Terms of service

These terms are an agreement between you and DVC Topia. They apply whenever you use dvctopia.com, whether you're a Disney Vacation Club owner renting out points ("owner") or a traveler renting them ("renter"). By creating an account or using the site, you agree to these terms and to our privacy policy.

What DVC Topia is

DVC Topia is a marketplace that connects owners with renters. Owners set their own prices and make reservations with Disney Vacation Club using their own points. DVC Topia isn't a travel agent, a resort operator, or a party to your stay, and doesn't own any points or reservations.

DVC Topia is not affiliated with, endorsed by, or sponsored by The Walt Disney Company or Disney Vacation Club. Disney sets the rules for memberships, points and reservations, and can change them at any time.

Your account

• You must be at least 18 years old and able to enter into a binding contract.
• Give accurate information, keep it up to date, and keep your password safe. You're responsible for activity on your account.
• One person per account. Don't create an account for someone else or share yours.
• We may ask you to verify your identity before you can list points, book, or receive payouts.

Owners

If you list points, you confirm that:

• You're the owner (or an authorized co-owner) of the Disney Vacation Club membership, and it's in good standing, with dues paid.
• The points and travel dates you offer are real and available to you.
• You'll make the reservation exactly as agreed (resort, room type, view, dates and guest names) and won't change or cancel it without the renter's agreement.
• You'll follow Disney Vacation Club's rules, including its limits on rentals and reservations made for others.
• You're responsible for any taxes owed on your rental income.

Renters

• Give accurate guest details. Disney requires names to match the people staying, and owners need them to make the reservation.
• Follow the resort's rules during your stay. You're responsible for any charges or damage you or your guests cause at the resort.
• Book and pay only through DVC Topia. Paying an owner outside the site removes our payment protection.

Bookings and payments

• The price, our service fee and any payment plan are shown before you pay. By paying, you agree to that total.
• Payments are processed by Stripe. Card and bank details go to Stripe, not to us.
• We hold the renter's payment and release it to the owner after the reservation is confirmed and verified, or at check-in, as shown for the booking. This protects both sides.
• If you choose a payment plan, each installment is charged on its due date. If an installment can't be collected, we'll let you know. If it stays unpaid, the booking may be cancelled under the booking's cancellation terms.
• Owners receive payouts through Stripe to the account they connect.

Cancellations and refunds

• The cancellation terms shown when you book apply to that booking.
• If an owner cancels or can't make the agreed reservation, the renter gets a full refund of what they've paid.
• Disney's own rules decide what happens to an owner's points when a reservation is cancelled, and those rules depend on how close to check-in the cancellation happens.
• If something goes wrong with a booking, contact us. We'll look at the booking records and messages, and decide how held funds are released or refunded.

Things you may not do

• Post false listings, false reviews, or anyone else's membership information.
• Use the site to arrange payment outside DVC Topia, or to contact members for anything other than booking stays.
• Harass, threaten or discriminate against other members.
• Scrape the site, interfere with how it works, or try to access other members' accounts or data.
• Break the law or Disney Vacation Club's rules.

Content you post

You keep ownership of the listings, messages, photos and reviews you post. You give DVC Topia permission to display and share them on the site to run the marketplace. We may remove content that breaks these terms. Reviews must be honest and based on a real booking.

Suspension and closing your account

You can close your account at any time (see deleting your data). We may suspend or close accounts that break these terms or put other members at risk. Closing an account doesn't cancel bookings that are already paid for or underway.

Disclaimers

We work to keep listings accurate and the site running, but we provide DVC Topia "as is". We don't guarantee that every listing is accurate, that Disney will have availability, or that the site will always be available. Point charts, availability and resort details come from owners and public sources and may change.

Limitation of liability

To the fullest extent the law allows, DVC Topia isn't liable for indirect or consequential losses. Our total liability for any claim about a booking is limited to the amount you paid through DVC Topia for that booking. Nothing in these terms limits liability that can't legally be limited.

Changes to these terms

If we change these terms, we'll update the date at the top of this page. For significant changes, we'll also tell members by email or on the site before they take effect. If you keep using DVC Topia after a change, you accept the new terms.
